Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the TGpost platform ("Service"), operated by KCS Creations, a business registered in India with its office at A 1503, Plot No. GH02, Sector 107, Noida, Gautam Buddha Nagar, Uttar Pradesh – 201301.

By accessing or using TGpost at tgpost.app, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years of age to use the Service. By registering, you represent that you are of legal age and have the authority to enter into these Terms.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information during registration and to update it promptly if it changes.

4. Description of Service

TGpost is a SaaS platform that enables Telegram channel owners to:

• Connect and manage Telegram channels via bots
• Schedule and publish posts
• Track channel analytics and subscriber growth
• Create and manage paid VIP membership groups
• Use message templates and recurring auto-posters
• Manage a media library

5. Subscription Plans & Payments

TGpost offers free and paid subscription plans. Paid plans are billed on a monthly or annual basis as displayed at the time of purchase. All prices are in USD unless stated otherwise.

Payments are processed through our third-party payment partners. By subscribing, you authorise recurring charges to your chosen payment method until you cancel.

6. Cancellation & Refund Policy

You may cancel your subscription at any time from your account settings. Upon cancellation:

• You retain access to paid features until the end of your current billing period.
• No further charges will be made after cancellation.
• Your account will revert to the Free plan at the end of the billing period.

Refund policy:

• Refund requests must be submitted within 7 days of the payment date by emailing Support@tgpost.app.
• Refunds are processed within 5–7 business days to the original payment method.
• Refunds will not be issued for partial months of use or if the account has been suspended for a violation of these Terms.
• For crypto payments processed through NOWPayments, refunds will be issued in the same cryptocurrency at the prevailing exchange rate at the time of refund, subject to network fees.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Send spam, unsolicited messages, or bulk automated posts
• Distribute malware, phishing content, or fraudulent material
• Infringe upon the intellectual property rights of others
• Harass, abuse, or harm other users
• Attempt to gain unauthorised access to the Service or its infrastructure

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

8. Telegram Bot Tokens

When you connect a Telegram bot, you provide your bot token. We encrypt all tokens using AES-256-GCM before storage and only decrypt them server-side for the purpose of executing your requested actions (sending messages, creating invite links, etc.). You remain the sole owner of your bot and are responsible for its use in compliance with Telegram's Terms of Service.

9. VIP Membership Groups

If you use TGpost to run paid VIP membership groups, you are solely responsible for:

• Delivering the content or access promised to your members
• Handling disputes with your members
• Complying with applicable tax, consumer protection, and payment regulations

TGpost facilitates the payment and membership infrastructure but is not a party to the agreement between you and your members.

10. Intellectual Property

All content, trademarks, and intellectual property associated with TGpost are owned by KCS Creations. You retain ownership of the content you create and post through the Service.

11. Limitation of Liability

To the maximum extent permitted by law, KCS Creations shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted or error-free operation of the Service.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gautam Buddha Nagar, Uttar Pradesh, India.

14. Modifications

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify registered users of material changes via email or in-app notification.
